Our services<\/p>\n<p data-start=\"1436\" data-end=\"1692\">1.1 Nova Physio &amp; Rehab provides physiotherapy and rehabilitation services delivered by qualified practitioners who are registered with the Australian Health Practitioner Regulation Agency (AHPRA), or who work under the supervision of such practitioners.<\/p>\n<p data-start=\"1694\" data-end=\"1873\">1.2 Our services may include assessment, diagnosis, manual therapy, exercise prescription, education, rehabilitation programs and related services appropriate to your condition.<\/p>\n<p data-start=\"1875\" data-end=\"2006\">1.3 We will provide our services with reasonable care and skill and in accordance with applicable professional and legal standards.<\/p>\n<hr data-start=\"2008\" data-end=\"2011\" \/>\n<p data-start=\"2013\" data-end=\"2044\">2. Bookings and appointments<\/p>\n<p data-start=\"2046\" data-end=\"2182\">2.1 Appointments can be made in person, by phone, online (where available) or by any other method we make available from time to time.<\/p>\n<p data-start=\"2184\" data-end=\"2262\">2.2 When you book an appointment, we reserve that time specifically for you.<\/p>\n<p data-start=\"2264\" data-end=\"2435\">2.3 You are responsible for ensuring your contact details (including email and mobile number) are accurate so that appointment confirmations and reminders can reach you.<\/p>\n<p data-start=\"2437\" data-end=\"2589\">2.4 We may send courtesy reminders by SMS or email; however, these are not guaranteed. It remains your responsibility to remember your appointment time.<\/p>\n<hr data-start=\"2591\" data-end=\"2594\" \/>\n<p data-start=\"2596\" data-end=\"2618\">3. Fees and payment<\/p>\n<p data-start=\"2620\" data-end=\"2767\">3.1 Our consultation fees and any additional service fees will be communicated to you at the time of booking, or prior to or at your appointment.<\/p>\n<p data-start=\"2769\" data-end=\"2853\">3.2 Unless otherwise agreed in advance, <strong data-start=\"2809\" data-end=\"2850\">payment is due at the time of service<\/strong>.<\/p>\n<p data-start=\"2855\" data-end=\"2991\">3.3 We accept the payment methods notified at the clinic from time to time (for example, EFTPOS, credit card, cash, or other methods).<\/p>\n<p data-start=\"2993\" data-end=\"3151\">3.4 Where we offer on-the-spot private health fund claiming, you remain responsible for any <strong data-start=\"3085\" data-end=\"3092\">gap<\/strong> or <strong data-start=\"3096\" data-end=\"3113\">out-of-pocket<\/strong> amount not covered by your insurer.<\/p>\n<p data-start=\"3153\" data-end=\"3371\">3.5 If your consultation is funded by a third party (such as workers\u2019 compensation, CTP, DVA, NDIS, or other funding body), you remain responsible for any fees that are not paid or only partially paid by that funder.<\/p>\n<p data-start=\"3373\" data-end=\"3563\">3.6 We may charge reasonable administrative fees for late payments, debt collection, or for additional non-clinical services (for example, preparing detailed reports) where permitted by law.<\/p>\n<hr data-start=\"3565\" data-end=\"3568\" \/>\n<p data-start=\"3570\" data-end=\"3607\">4. Cancellation and no-show policy<\/p>\n<p data-start=\"3609\" data-end=\"3783\">4.1 We understand that unexpected events occur. However, late cancellations and missed appointments significantly impact our ability to provide timely care to all patients.<\/p>\n<p data-start=\"3785\" data-end=\"3908\">4.2 Unless otherwise agreed, we require <strong data-start=\"3825\" data-end=\"3854\">at least 24 hours\u2019 notice<\/strong> if you need to reschedule or cancel an appointment.<\/p>\n<p data-start=\"3910\" data-end=\"4125\">4.3 If you cancel your appointment with less than 24 hours\u2019 notice, or do not attend your appointment without notice (\u201cno-show\u201d), we <strong data-start=\"4043\" data-end=\"4076\">may charge a cancellation fee<\/strong>, which may be up to the full consultation fee.<\/p>\n<p data-start=\"4127\" data-end=\"4293\">4.4 Cancellation and no-show fees are generally <strong data-start=\"4175\" data-end=\"4192\">not claimable<\/strong> through Medicare, private health insurance or other funding bodies. These fees are payable by you.<\/p>\n<p data-start=\"4295\" data-end=\"4394\">4.5 We may exercise discretion to waive or reduce cancellation fees in exceptional circumstances.<\/p>\n<p data-start=\"4396\" data-end=\"4542\">4.6 Repeated late cancellations or non-attendance may result in us requiring pre-payment for future appointments or limiting your ability to book.<\/p>\n<hr data-start=\"4544\" data-end=\"4547\" \/>\n<p data-start=\"4549\" data-end=\"4599\">5. Treatment, consent and your responsibilities<\/p>\n<p data-start=\"4601\" data-end=\"4752\">5.1 By attending an appointment and agreeing to treatment, you provide your <strong data-start=\"4677\" data-end=\"4697\">informed consent<\/strong> to assessment and treatment by your physiotherapist.<\/p>\n<p data-start=\"4754\" data-end=\"4822\">5.2 Before or during treatment, your physiotherapist will explain:<\/p>\n<ul data-start=\"4823\" data-end=\"5006\">\n<li data-start=\"4823\" data-end=\"4889\">\n<p data-start=\"4825\" data-end=\"4889\">The nature and purpose of proposed assessments and treatments;<\/p>\n<\/li>\n<li data-start=\"4890\" data-end=\"4947\">\n<p data-start=\"4892\" data-end=\"4947\">Any reasonably foreseeable risks or side effects; and<\/p>\n<\/li>\n<li data-start=\"4948\" data-end=\"5006\">\n<p data-start=\"4950\" data-end=\"5006\">Any reasonable alternative options, where appropriate.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5008\" data-end=\"5101\">5.3 You may <strong data-start=\"5020\" data-end=\"5055\">withdraw or modify your consent<\/strong> at any time by informing your practitioner.<\/p>\n<p data-start=\"5103\" data-end=\"5138\">5.4 It is your responsibility to:<\/p>\n<ul data-start=\"5139\" data-end=\"5429\">\n<li data-start=\"5139\" data-end=\"5263\">\n<p data-start=\"5141\" data-end=\"5263\">Provide accurate, complete and up-to-date information about your medical history, medications and current health status;<\/p>\n<\/li>\n<li data-start=\"5264\" data-end=\"5330\">\n<p data-start=\"5266\" data-end=\"5330\">Inform your practitioner of any changes in your condition; and<\/p>\n<\/li>\n<li data-start=\"5331\" data-end=\"5429\">\n<p data-start=\"5333\" data-end=\"5429\">Follow reasonable treatment advice, exercises and recommendations to the best of your ability.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5431\" data-end=\"5458\">5.5 You acknowledge that:<\/p>\n<ul data-start=\"5459\" data-end=\"5668\">\n<li data-start=\"5459\" data-end=\"5545\">\n<p data-start=\"5461\" data-end=\"5545\">Physiotherapy, like all healthcare, may involve some degree of risk or discomfort;<\/p>\n<\/li>\n<li data-start=\"5546\" data-end=\"5602\">\n<p data-start=\"5548\" data-end=\"5602\">Treatment outcomes can vary between individuals; and<\/p>\n<\/li>\n<li data-start=\"5603\" data-end=\"5668\">\n<p data-start=\"5605\" data-end=\"5668\"><strong data-start=\"5605\" data-end=\"5668\">No specific result or recovery timeframe can be guaranteed.<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5670\" data-end=\"5820\">5.6 If at any time you experience unusual pain, discomfort, or have concerns about your treatment, you should inform your physiotherapist immediately.<\/p>\n<hr data-start=\"5822\" data-end=\"5825\" \/>\n<p data-start=\"5827\" data-end=\"5872\">6. Children and substitute decision-makers<\/p>\n<p data-start=\"5874\" data-end=\"6026\">6.1 For patients under 18 years of age, a parent or legal guardian should ordinarily attend the initial consultation and provide consent to treatment.<\/p>\n<p data-start=\"6028\" data-end=\"6246\">6.2 Where a patient lacks capacity to provide informed consent, an authorised substitute decision-maker (for example, a legal guardian or holder of an enduring power of attorney, where applicable) must provide consent.<\/p>\n<hr data-start=\"6248\" data-end=\"6251\" \/>\n<p data-start=\"6253\" data-end=\"6299\">7. Telehealth consultations (if applicable)<\/p>\n<p data-start=\"6301\" data-end=\"6395\">7.1 We may offer telehealth (video or telephone) consultations where clinically appropriate.<\/p>\n<p data-start=\"6397\" data-end=\"6461\">7.2 By booking a telehealth appointment, you acknowledge that:<\/p>\n<ul data-start=\"6462\" data-end=\"6639\">\n<li data-start=\"6462\" data-end=\"6533\">\n<p data-start=\"6464\" data-end=\"6533\">Telehealth has limitations compared to face-to-face assessment; and<\/p>\n<\/li>\n<li data-start=\"6534\" data-end=\"6639\">\n<p data-start=\"6536\" data-end=\"6639\">There may be risks associated with technology, including interruptions, delays or technical failures.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"6641\" data-end=\"6771\">7.3 You are responsible for ensuring you have a suitable private environment and appropriate technology for telehealth sessions.<\/p>\n<p data-start=\"6773\" data-end=\"6912\">7.4 The same fees, cancellation policies, and consent principles generally apply to telehealth consultations as to in-person consultations.<\/p>\n<hr data-start=\"6914\" data-end=\"6917\" \/>\n<p data-start=\"6919\" data-end=\"6958\">8. Third-party funding and referrals<\/p>\n<p data-start=\"6960\" data-end=\"7237\">8.1 Where your services are funded or partially funded by a third party (for example, Medicare, workers\u2019 compensation, CTP, DVA, NDIS, or an insurer), you authorise us to share necessary information with that funder to facilitate payment and management of your claim or plan.<\/p>\n<p data-start=\"7239\" data-end=\"7359\">8.2 Even where a third party is involved, you remain responsible for any amounts not covered by that payer, including:<\/p>\n<ul data-start=\"7360\" data-end=\"7473\">\n<li data-start=\"7360\" data-end=\"7384\">\n<p data-start=\"7362\" data-end=\"7384\">Co-payments or gaps;<\/p>\n<\/li>\n<li data-start=\"7385\" data-end=\"7438\">\n<p data-start=\"7387\" data-end=\"7438\">Services not approved or outside plan limits; and<\/p>\n<\/li>\n<li data-start=\"7439\" data-end=\"7473\">\n<p data-start=\"7441\" data-end=\"7473\">Cancellation and no-show fees.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"7475\" data-end=\"7710\">8.3 You are responsible for ensuring that you hold any required referral, plan, approval or documentation (for example, a GP referral, EPC\/Chronic Disease Management plan, or insurer approval) prior to your appointment where necessary.<\/p>\n<hr data-start=\"7712\" data-end=\"7715\" \/>\n<p data-start=\"7717\" data-end=\"7759\">9. Records, privacy and confidentiality<\/p>\n<p data-start=\"7761\" data-end=\"7903\">9.1 We maintain clinical records and other personal information in accordance with our professional obligations and applicable privacy laws.<\/p>\n<p data-start=\"7905\" data-end=\"8077\">9.2 Our <strong data-start=\"7913\" data-end=\"7931\">Privacy Policy<\/strong> sets out in detail how we collect, use, disclose and protect your personal information, and your rights to access and correct your information.<\/p>\n<p data-start=\"8079\" data-end=\"8199\">9.3 By engaging our services, you acknowledge that you have had the opportunity to access and review our Privacy Policy.<\/p>\n<hr data-start=\"8201\" data-end=\"8204\" \/>\n<p data-start=\"8206\" data-end=\"8264\">10. Australian Consumer Law and limitation of liability<\/p>\n<p data-start=\"8266\" data-end=\"8482\">10.1 Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the <strong data-start=\"8383\" data-end=\"8410\">Australian Consumer Law<\/strong> or other applicable laws that cannot lawfully be excluded or limited.<\/p>\n<p data-start=\"8484\" data-end=\"8565\">10.2 To the extent permitted by law, and subject to your non-excludable rights:<\/p>\n<ul data-start=\"8566\" data-end=\"8938\">\n<li data-start=\"8566\" data-end=\"8777\">\n<p data-start=\"8568\" data-end=\"8777\">Our liability for any failure to comply with a statutory guarantee in relation to services is limited, at our option, to resupplying the services or paying the cost of having the services supplied again; and<\/p>\n<\/li>\n<li data-start=\"8778\" data-end=\"8938\">\n<p data-start=\"8780\" data-end=\"8938\">We are not liable for any indirect, special or consequential loss, or loss of opportunity, arising out of or in connection with our services or these Terms.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"8940\" data-end=\"9099\">10.3 These limitations do not apply where it would be unlawful to exclude or limit liability, including where liability cannot be limited under applicable law.<\/p>\n<hr data-start=\"9101\" data-end=\"9104\" \/>\n<p data-start=\"9106\" data-end=\"9136\">11. Behaviour in the clinic<\/p>\n<p data-start=\"9138\" data-end=\"9242\">11.1 We are committed to providing a safe and respectful environment for patients, visitors and staff.<\/p>\n<p data-start=\"9244\" data-end=\"9345\">11.2 We reserve the right to decline treatment, reschedule, or discontinue services where a person:<\/p>\n<ul data-start=\"9346\" data-end=\"9594\">\n<li data-start=\"9346\" data-end=\"9422\">\n<p data-start=\"9348\" data-end=\"9422\">Engages in aggressive, threatening, discriminatory or abusive behaviour;<\/p>\n<\/li>\n<li data-start=\"9423\" data-end=\"9515\">\n<p data-start=\"9425\" data-end=\"9515\">Is under the influence of drugs or alcohol in a way that affects safety or treatment; or<\/p>\n<\/li>\n<li data-start=\"9516\" data-end=\"9594\">\n<p data-start=\"9518\" data-end=\"9594\">Otherwise behaves in a way that compromises safety, care or staff wellbeing.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"9596\" data-end=\"9599\" \/>\n<p data-start=\"9601\" data-end=\"9631\">12. Complaints and feedback<\/p>\n<p data-start=\"9633\" data-end=\"9794\">12.1 We welcome feedback on our services. If you have a concern or complaint, please raise it with us as soon as possible so we can try to resolve it promptly.<\/p>\n<p data-start=\"9796\" data-end=\"9945\">12.2 You can provide feedback or lodge a complaint in person, by phone, or in writing using the contact details on our website or clinic materials.<\/p>\n<p data-start=\"9947\" data-end=\"10145\">12.3 If you are not satisfied with our response, you may be able to escalate your complaint to external bodies, such as the Office of the Health Ombudsman in Queensland or other relevant regulators.<\/p>\n<hr data-start=\"10147\" data-end=\"10150\" \/>\n<p data-start=\"10152\" data-end=\"10181\">13. Changes to these Terms<\/p>\n<p data-start=\"10183\" data-end=\"10310\">13.1 We may amend these Terms from time to time to reflect changes in our services, business practices or legal requirements.<\/p>\n<p data-start=\"10312\" data-end=\"10429\">13.2 The most current version of these Terms will be available at our clinic and, where applicable, on our website.<\/p>\n<p data-start=\"10431\" data-end=\"10552\">13.3 By continuing to use our services after any changes are published, you are taken to have accepted the updated Terms.<\/p>\n<hr data-start=\"10554\" data-end=\"10557\" \/>\n<p data-start=\"10559\" data-end=\"10579\">14.
